No exactamente.

Private Sector & Business Employment in India — Complete Labor Guide
Everything a company or private-sector worker needs to know to operate or work in India: the new 2025-2026 Labour Codes, wages and payments, social security (EPF/ESI), dismissals and compensation, platform workers, unions, and multi-state employer compliance. Content verified against official sources.
What are India’s four new Labour Codes?
Four laws that replace and consolidate 29 previous central labour laws, some over 70 years old: the Code on Wages (wages, unifying 4 prior laws including the Payment of Bonus Act), the Industrial Relations Code (collective relations, replacing the Industrial Disputes Act), the Code on Social Security (EPF, ESI, gratuity, maternity) and the Occupational Safety, Health and Working Conditions Code (working hours, safety and hygiene). They came into force on November 21, 2025.
If the Codes have been in force since November 2025, why is there still talk of implementation in 2026?
Because the central law taking effect is one thing, and its implementing rules are another. The Ministry of Labour published draft central rules on December 30, 2025, with a 30-to-45-day comment period depending on the code, and final central rules were expected only by April 2026. In addition, each Indian state must notify its own state-level rules — as of May 2026, more than 30 states and union territories had notified rules for at least one code, but at very different paces, creating an uneven compliance landscape depending on where the company is based.
What changes in the legal definition of “wages” under the Code on Wages?
The new definition of “wages” includes all remuneration except for specific, exhaustive exclusions (such as HRA, travel allowances, overtime, and bonuses) — but those exclusions are now capped at 50% of total remuneration. In practice, this forces many companies to redesign their salary structure: if they historically paid a very high proportion in non-wage components to reduce the contribution base, at least 50% of the package must now count as basic wage for EPF, gratuity, and other legal calculations.
When must the monthly salary be paid in India?
The Code on Wages requires the monthly salary to be paid no later than the 7th day of the following month. This is a concrete legal deadline, not a mere guideline, and systematic non-compliance can result in claims before the labour authority.
How long does the employer have to pay the final settlement after an employee leaves?
Section 17(2) of the Code on Wages sets a deadline of two working days from the date of separation for the full and final settlement, regardless of whether the separation was a resignation, dismissal, or retrenchment. This is a very significant change from prior practice, where settlements could take 30 to 45 days with no strict legal deadline in place.
Is there a single, nationwide minimum wage in India?
Not exactly. The Code on Wages sets the general framework, but the effective minimum wage remains multi-tiered: it varies by required skill level (unskilled, semi-skilled, skilled, highly skilled), by industry sector, and by geographic zone (India classifies areas into categories A, B, and C based on cost of living). In practice, there is no single number applicable to the whole country.
Is the Equal Remuneration Act still in force, and is it now part of the Code on Wages?
Yes, its principles were incorporated into the Code on Wages: it requires equal pay for men and women for the same work or work of a similar nature, and it prohibits wage discrimination based on gender, both in hiring and in subsequent employment conditions.
How many weeks of paid maternity leave apply in India’s private sector?
Chapter VI of the Code on Social Security establishes 26 weeks of fully paid maternity leave for the first two children, and 12 weeks from the third child onward. It applies to every private establishment with 10 or more employees. This is one of the most extensive paid maternity leave regimes in the world in terms of weeks covered.
Is paternity leave mandatory in India’s private sector?
No. Unlike maternity leave, India does not, as of this publication, have mandatory paternity leave in the private sector — this is a genuine legal gap, not an omission on our part. Legislative proposals were under discussion during 2026 to introduce it, and in March 2026 the Supreme Court, in a ruling on adoption leave, explicitly noted the need to address paternity within the social security framework — but until that becomes law, any paternity leave at an Indian company is a discretionary benefit, not a legal entitlement.
What did the Supreme Court establish in March 2026 regarding adoption leave?
It extended the 12 weeks of adoption leave to all adoptive mothers, removing the previous limit that restricted the benefit to adopting children up to three months of age. This is a recent ruling that is relevant to any company managing personnel leave in India.
Which employers are required to provide crèche (childcare) facilities?
Establishments with 50 or more employees must provide crèche facilities under the Code on Social Security, allowing mothers up to four visits to their children per day. Where a physical crèche is not feasible, the employer may instead grant a crèche allowance, ensuring equal continuity of childcare.
What is the maximum legal working day for private-sector workers?
The classic reference under the Factories Act and state Shops and Establishments Acts is 9 hours per day and 48 hours per week, with overtime paid at double the normal rate. The new Occupational Safety, Health and Working Conditions Code keeps the 48-hour weekly ceiling but allows greater flexibility in daily distribution (up to 12 hours under some schemes, offset by fewer working days), subject to the relevant state rules already being notified.
What are the EPF contribution rates for a local (non-international) worker?
12% from the employee and 12% from the employer, both calculated on the applicable wage ceiling. Of the employer’s 12%, 8.33 percentage points go to the Employees’ Pension Scheme (EPS) and the remaining 3.67 points to the worker’s individual EPF account.
What is the wage ceiling used to calculate EPF for a local worker?
Currently INR 15,000 per month. This figure is in flux: a Supreme Court directive from January 2026 could lead to a revision of that ceiling toward INR 21,000 or even INR 25,000 — something any HR department running payroll in India should actively monitor, since it directly affects the social-security cost per employee.
Above what company size does EPF become mandatory?
EPF applies to establishments with 20 or more employees. Below that threshold, enrollment is not legally mandatory (though some employers choose to offer it anyway as a benefit).
What are the ESI contribution rates and wage ceiling?
ESI remains at a total of 4% of gross wages (3.25% from the employer, 0.75% from the employee), applicable to workers earning up to INR 21,000 per month (INR 25,000 for persons with disabilities). It covers factories and specific establishments with 10 or more employees, in areas notified by ESI.
When is the monthly EPF and ESI payment due?
Both are paid through the same electronic challan (ECR), due on the 15th of the following month. This is a different date from the salary payment deadline (the 7th), so it’s worth keeping a separate compliance calendar for each obligation.
What is the retrenchment (economic dismissal) compensation formula in India?
15 days of average wages for each completed year of service, calculated on the average of the last three months’ wages. It applies to workers with at least 12 months of continuous service, and specifically corresponds to dismissals for economic reasons (not to disciplinary dismissals for cause).
How much notice is required before a dismissal in India?
It varies considerably: between 15 and 90 days depending on the type of position, the size of the organization, seniority, and the applicable state legislation. As a general reference: junior staff typically get 30 days, managers or senior staff between 60 and 90 days, and workmen under Standing Orders 30 days.
What are Standing Orders, and which companies are required to have them?
They are mandatory internal regulations that set employment conditions, discipline, and separation procedures. The new Industrial Relations Code raised the mandatory-application threshold from 100 to 300 workers — establishments below that number are subject to generic “model standing orders” instead of having to draft their own, a compliance relief for mid-sized companies.
From how many years of service is gratuity due, and why are there two different answers depending on contract type?
For a standard permanent employee, the classic rule of 5 years of continuous service still applies, with a payment of 15 days’ wages per year. But the Code on Social Security introduced a new, specific protection for fixed-term employees: they are entitled to gratuity on a pro-rata basis from the very first year, without waiting for the 5-year mark — a change designed not to leave the growing share of Indian workers on temporary contracts unprotected, since they historically rotated out before reaching the classic threshold.
Is there a maximum tax-exempt amount for gratuity?
Yes, INR 2,000,000 (2 million rupees) as the tax-exemption cap. Gratuity amounts exceeding that ceiling are subject to income tax on the excess.
What is the Worker Re-Skilling Fund, and when must the employer contribute to it?
It is a re-skilling fund to which the employer must deposit 15 days of the worker’s last drawn wages, within 45 days of the retrenchment. This is an obligation additional to the compensation itself, designed to fund the reemployment of workers dismissed for economic reasons.
What is the difference between “layoff” and “retrenchment” under Indian legislation?
A layoff is a temporary suspension of work due to shortage of materials, power, accumulation of stock, or other operational reasons, without terminating the employment relationship. Retrenchment is the permanent termination of the relationship for economic reasons. Both give rise to a right to compensation, but they are calculated differently under the Industrial Relations Code, and confusing the two is a common compliance mistake among companies new to operating in India.
Does India legally recognize platform (gig) workers?
Yes, for the first time: the Code on Social Security, 2020 is the first Indian central law to formally define gig and platform workers as their own category, distinct from both the traditional employee and the generic independent contractor.
What must platforms (aggregators) contribute toward their workers’ social security?
Between 1% and 2% of their annual turnover, capped at 5% of payments made or due to gig/platform workers, to a dedicated Social Security Fund. Companies such as Uber, Ola, Swiggy, Zomato, and Flipkart are expressly covered by this obligation.
What benefits does this Social Security Fund finance for gig workers?
Section 114 of the Code enables life and disability insurance schemes, accident insurance, health and maternity benefits, and old-age protection — risk categories that, before this reform, platform workers bore entirely on their own, with no contribution obligation on the part of aggregators.
Are a gig worker’s social-security benefits portable across different apps?
Yes, that is precisely the intended design: the worker registers once on the e-Shram portal (eshram.gov.in), and the accumulated benefits are tied to the person, not to a specific platform — so they can switch apps or work for several at once without losing accumulated coverage.
When does the gig-worker regime take full effect?
The Code on Social Security sets April 2026 as the target date for full operationalization of the regime, although — as with the rest of the Codes — actual implementation depends on the implementing rules being completed at both the central and state levels.
What state-level registration is mandatory for almost any office or shop in India?
Registration under the relevant state’s Shops and Establishments Act, which regulates opening hours, working time, leave, and basic employment conditions at the local level. Since each state has its own version of this law, the specific rules vary significantly — Karnataka (home to Bangalore’s tech hub) does not have exactly the same rules as Maharashtra (Mumbai) or Delhi.
Which companies must set up an Internal Committee under the POSH Act?
Every company with 10 or more employees must establish an Internal Committee for the prevention and handling of sexual harassment complaints, under the Sexual Harassment of Women at Workplace Act of 2013. This obligation is independent of the new Labour Codes and remains fully in force.
What happens if a company operates in several Indian states with different rules?
It must comply with the specific requirements of each state where it has employees or registered establishments — there is no single national regime that replaces state-level particularities, not even under the new Labour Codes. The practical recommendation for any multi-state company is to maintain an up-to-date, state-by-state compliance map, rather than assume that head-office rules apply uniformly across all branches.
What is the practical risk for a company that does not update its salary structure to the new “wages” definition under the Code on Wages?
It risks miscalculating EPF, gratuity, and other statutory benefits on an outdated calculation base, with the resulting exposure to claims and penalties if the labour authority audits the salary structure. Since the 50%-minimum rule on wage components is relatively recent, it is a priority review item for any company running payroll in India that hasn’t updated its compensation structure since November 2025.
What is the Payment of Bonus Act, and is it still in force under the Code on Wages?
Yes, its provisions were absorbed into the Code on Wages: a mandatory annual bonus of between 8.33% and 20% of wages, for employees earning up to a wage ceiling set by notification (historically INR 21,000 per month), applicable to establishments with 20 or more employees and to workers with at least 30 days worked during the year.
How does income-tax withholding (TDS) on salary work in India?
Under Section 192 of the Income Tax Act, the employer must withhold TDS monthly based on the projected annual salary of the employee. There are two tax regimes an employee can choose between each fiscal year: the old regime (more exemptions and deductions) and the new regime (lower rates but without most of those exemptions).
What is “Professional Tax,” and who collects it?
It is a state-level, not central, tax on the practice of a profession or employment. Not every state levies it — Maharashtra, Karnataka, and West Bengal do, Delhi does not, for example — and where it exists, the employer withholds it monthly from wages, subject to a legal cap of INR 2,500 per year.
Can an employee make a partial EPF withdrawal before leaving employment?
Yes, under specific rules depending on the reason: housing, marriage, education, or medical treatment allow partial withdrawals with different percentages and waiting periods. A full withdrawal, on the other hand, is only available after two months of continuous unemployment or upon reaching age 58 — except for the case of permanent settlement abroad, which has its own rules.
What deductions are mandatory besides EPF, ESI, and income tax?
Depending on the state and sector: the Labour Welfare Fund (a minimal contribution, semi-annual in several states), Professional Tax where the state applies it, and union dues if the worker is a member and has expressly authorized them.
What is Fixed Term Employment (FTE), and why is it a key feature of the reform?
It is direct fixed-term hiring, without intermediation by an agency, established as national policy and later incorporated into the Industrial Relations Code. It gives companies flexibility to hire by project or season without resorting to staffing contractors, and it guarantees those workers parity of benefits (wages, leave, pro-rata gratuity) with comparable permanent staff.
How does fixed-term employment (FTE) differ from work contracted through an agency (contract labour)?
FTE is a direct employment relationship between the company and the worker, with benefit parity. Contract labour involves an intermediary contractor: the worker has no direct employment relationship with the principal company, although the company retains subsidiary liability in certain respects, such as paying wages if the contractor defaults.
Are there restrictions on outsourcing a company’s “core” activities?
Yes, the Industrial Relations Code maintains the restriction on outsourcing an establishment’s core or permanent activities through contract labour, except for specific exceptions (seasonal peaks, specialized or intermittent activities). Core activity must be covered by direct staff or through FTE.
What happens to a fixed-term worker when their contract ends?
When the agreed term expires, the relationship ends automatically and this does not constitute retrenchment — so it does not trigger the 15-days-per-year compensation associated with economic dismissal. The worker may still be entitled to pro-rata gratuity if they accumulated at least one year of service, a specific benefit the Code on Social Security grants them just as it does a permanent employee.
Does a staffing agency need a license to operate in India?
Yes, it must register and obtain a license under the contract-labour provisions of the Industrial Relations Code. In turn, every company using contractors must register as a “principal employer” — operating without this dual registration is a common violation that labour authorities check for during inspections.
Is it legal to strike in India without prior notice?
It depends on the type of establishment. In “public utility services” (power, water, transport, hospitals, among others, exhaustively defined by law), prior notice of between 14 and 60 days is required before a strike or lockout. The Industrial Relations Code also extended notice requirements to strikes outside public utility services, something that previously did not exist uniformly at the national level.
What majority is required to call a legal strike?
The Industrial Relations Code requires the strike to be approved by a ballot with a majority of the establishment’s workers — an internal union-governance requirement that did not previously exist uniformly at the national level.
What dispute-resolution mechanisms exist before reaching a strike?
First, conciliation before a government-appointed Conciliation Officer; if unresolved, the dispute is referred to an Industrial Tribunal or Labour Court. During the formal conciliation period, strikes and lockouts are prohibited by law.
What threshold determines whether a union can negotiate on behalf of all workers at an establishment?
The Industrial Relations Code introduced, for the first time at the central level, an objective criterion: a union representing at least 51% of an establishment’s workers can be recognized as the “sole negotiating union.” If none reaches that threshold, a “negotiating council” is formed proportional to the membership of each union with at least 20% membership.
What is the Shram Suvidha portal, and what is it used for by employers?
It is the Indian Ministry of Labour’s unified digital platform for establishment registration, filing labour returns, and paying certain obligations — designed to replace the multiplicity of paper forms that each labour law previously required separately.
Does the IT/ITES sector (technology and outsourced services) have a different labour regime than other sectors?
In several states, yes. Karnataka, Telangana, and Tamil Nadu, among the main tech hubs, have specific exemptions or flexibilities for IT/ITES under their respective Shops and Establishments Acts — typically around night work for women (subject to safety and transport guarantees) and overtime limits, in recognition of projects with international delivery schedules.
What is “self-certification” for labour inspections?
Several states allow companies meeting certain criteria to self-certify compliance with specific labour rules instead of undergoing routine physical inspections, reducing the direct enforcement burden — although the government retains the power to inspect in response to complaints or on a random basis.
What happens if a company fails to file its periodic labour returns on time?
It can face administrative penalties and, in cases of repeated non-compliance, temporary disqualification from certain procedures or licenses. In addition, outdated returns are often the first trigger for a non-routine labour inspection.

Standing Orders
Worker Re-Skilling Fund
Sexual Harassment of Women at Workplace Act,
Payment of Bonus Act
“Professional Tax”
EPF, ESI
Fixed Term Employment (FTE)
Shram Suvidha
