What is the “five insurances and one fund” system?

This is the common name (五险一金) for China’s mandatory social insurance system: five insurances — pension, medical, unemployment, work injury, and maternity — plus the housing provident fund. Both employer and employee contribute set percentages, fixed by each city, on a salary base with minimum and maximum caps.

What does pension insurance (养老保险) cover?

It funds retirement income. The employer typically contributes around 16% of salary (this varies by province — for example 14% in Guangdong) and the employee 8%, split between a personal account and a collective pooling fund. Generally, a minimum of 15 years of contributions is required to access the full pension.

What does medical insurance (医疗保险) cover?

It covers part of the cost of medical treatment for illness or non-work-related injury. Rates vary by city — for example, in Shanghai the employer contributes around 10% and the employee 2%, plus a small fixed monthly fee. The system involves co-payments and reimbursement caps; it does not cover 100% of costs.

What does unemployment insurance (失业保险) cover?

It provides a temporary benefit to workers who lose their job involuntarily and meet minimum contribution requirements. The employer’s contribution is usually around 0.5%–1% of salary, with a smaller employee share in most cities.

What does work injury insurance (工伤保险) cover, and who pays for it?

It covers medical costs, disability compensation, and benefits to dependents in the event of a workplace accident or occupational disease, including certain commuting accidents. It is funded entirely by the employer — the employee makes no contribution to this insurance. The rate varies according to the risk level of the industry.

What does maternity insurance (生育保险) cover?

It covers the medical costs of pregnancy and childbirth, and funds the salary paid during maternity leave. In many cities it has now been administratively merged with medical insurance, though it remains a conceptually distinct benefit. It is funded by the employer.

What is the Housing Provident Fund

It is a mandatory savings scheme, technically separate from the five insurances, designed to help workers buy, build, or rent housing. Employer and employee each contribute between 5% and 12% of salary (the exact rate is set by each city within an allowed range), and the balance accumulates in an account held in the worker’s name.

Are contribution rates the same across the whole country?

No. While the legal framework (the Social Insurance Law of 2011) is national, each province and municipality sets its own exact rates, minimum and maximum salary bases, and implementation details within the ranges the national law allows. This is why the total cost varies noticeably between cities such as Shanghai, Beijing, or Shenzhen.

Roughly how much does the employer contribute in total?

Adding up all five insurances plus the housing fund, the employer’s total cost typically falls between 25% and 40% of the employee’s salary, depending on the city. This is a real and significant cost that foreign companies need to budget for from the outset — not an optional extra.

Is it mandatory to enroll foreign employees in the social insurance system?

Yes, as a general rule. Under MOHRSS’s Interim Measures, foreign employees holding a valid work permit must participate in the social insurance system on the same basis as Chinese employees, unless an exemption applies under a bilateral agreement (see the next question).

Are there exemptions for foreign employees?

Yes, for nationals of countries that have a bilateral social security (totalization) agreement in force with China. As of late 2026, China has agreements in force with roughly a dozen countries, including Germany, South Korea, Japan, Spain, the Netherlands, Switzerland, Canada, Finland, Luxembourg, Denmark, and Serbia (France has signed but the agreement is not yet in force).

How do the bilateral totalization/exemption agreements work?

Each agreement specifies which of the five insurances it exempts — pension and unemployment are the most commonly exempted, not necessarily all five. The purpose is to avoid double contributions when the employee is already contributing to their home country’s social security system.

Is the exemption under a bilateral agreement automatic?

No. The employee must present a valid certificate of coverage issued by their home country’s social security authority to the relevant local Chinese social security office, and the exemption is subject to that local office’s own interpretation and practice — it should be verified and processed before deciding not to contribute.

What happens to a foreign employee’s pension contributions if they leave China before reaching the required 15 years?

They may apply to close their individual pension account and withdraw the balance accumulated in that personal-account portion (not the share that went to the collective pooling fund) upon permanently leaving China and canceling their residence/work permit, following the procedure in force in the locality where they were registered.

Does the Housing Provident Fund apply to foreign employees?

It depends on the city. In many localities it is optional for foreigners (the company and employee can agree whether to participate), while in some cities, such as Shanghai, it can be mandatory under certain conditions. The specific local rule should be checked rather than assumed not to apply.

Is there a minimum and maximum salary base for calculating contributions?

Yes. Each city sets an annual floor and ceiling for the contribution base (typically tied to the local average salary), against which the percentages are applied — a very high salary does not generate proportionally unlimited contributions, and a very low salary still requires a minimum contribution calculated on the floor amount.

Who registers the employee in the system — the employer or the employee?

It is the employer’s obligation. The employer must register each new employee with the local social insurance system within a short window after the employment relationship begins, and handle the monthly withholdings and contributions — it is not something the employee is expected to initiate on their own.

What happens if the employer fails to make the required contributions?

This is a real compliance violation with consequences: the social insurance authority can demand retroactive payment of the missed contributions plus late fees, and the employee can raise a claim through labor mediation or arbitration. Failing to contribute can also expose the company to administrative penalties and damage its compliance standing for future inspections.

For labor-dispatch workers, who registers them for social insurance — the dispatch agency or the host company?

The dispatch agency, as the worker’s formal employer of record, is responsible for registering them and making social insurance contributions — not the host company where the worker performs day-to-day duties.

Does social medical insurance cover treatment at private or international hospitals?

Generally not, or only partially. Social medical insurance is built around a network of designated public hospitals; treatment at private clinics or international-standard hospitals (commonly used by expatriates) usually requires supplementary private health insurance, which many foreign companies purchase on top of the mandatory contribution.

What happens to pension contributions if an employee moves to a different city within China?

The system allows transferring the individual pension account (and, to a large extent, the medical insurance record) from one city to another when a worker relocates within the country, via an inter-regional transfer procedure. It is important to handle this correctly to avoid losing continuity in accumulated contribution years.

Can the Housing Provident Fund balance be withdrawn?

Yes, under specific circumstances: buying or building a home, paying rent, major medical expenses, retirement, or permanently leaving China, among other locally recognized grounds. It is not a fund that can be freely withdrawn at any time — withdrawal is subject to the grounds and procedures each city sets.

How long is maternity leave funded by maternity insurance?

The national floor is 98 days, but the vast majority of provinces extend it above that minimum through local population and family-planning regulations, commonly reaching 128–158 days or more depending on the locality. The specific rule of the province where the company is registered should always be checked.

Is there any paternity benefit for the other parent?

Yes, though it is not regulated uniformly at the national level: most provinces grant a short paternity leave (commonly between 7 and 30 days, depending on the locality) under their own population and family-planning regulations, generally paid through local mechanisms distinct from the national maternity insurance scheme.

How is work-injury disability graded?

The system uses a 10-grade scale, assessed jointly by the municipal labor-capacity appraisal committee, with input from the employer and the health authority — Grade 1 is the most severe (total incapacity) and Grade 10 the mildest. The grade determines the type and amount of compensation owed.

What compensation applies for Grades 1 to 4 (the most severe)?

These grades generally involve an inability to return to normal work, so the employment relationship must be maintained. The employee receives a one-time payment of roughly 24 months’ salary (Grade 1) plus a lifetime monthly allowance equal to 75%–90% of their salary, depending on the exact grade.

What compensation applies for Grades 5 to 10 (less severe)?

They receive a one-time lump-sum payment from the work-injury insurance fund, proportional to the grade — for example, Grade 5 typically entitles the worker to around 18 months’ salary plus a monthly allowance equal to 70% of pre-injury wages, while milder grades (closer to 10) receive smaller lump sums and generally no lifetime monthly allowance.

What is the occupational disease catalog, and how current is it?

It is the official list of conditions legally recognized as work-related, covered by work-injury insurance. After more than a decade without revision, the catalog was updated from 132 to 135 diseases across 12 categories, effective August 2025 — the update included, for the first time, work-related musculoskeletal disorders (such as carpal tunnel syndrome) as a recognized category.

What is the monthly unemployment benefit amount?

In most regions it is set at 70%–80% of the local minimum wage — for example, in Shanghai it is around ¥2,255 per month for the first 12 months, dropping to about ¥1,804 for months 13–24. The exact amount and its step-down vary by city.

How long can unemployment benefits be received?

The maximum duration depends on accumulated years of contribution: 1 to 5 years of contributions grants up to 12 months of benefits; 5 to 10 years grants up to 18 months; and more than 10 years grants up to 24 months. It is not an indefinite benefit, nor a fixed duration for everyone alike.

What is the Enterprise Annuity

It is a voluntary supplementary pension plan that a company may establish on top of the mandatory pension system, with contributions from the employer and, optionally, the employee, invested under a government-regulated framework. It does not replace mandatory pension insurance — it supplements it, and is more common at larger companies or in specific sectors as an added benefit to attract talent.

What is the difference between the individual account and the pooled fund within pension insurance?

The employee’s contribution (8% of salary) goes entirely into an individual account in the worker’s own name, which they can track and which in principle belongs to them. The employer’s contribution (around 16%) goes into a collective pooled fund used to finance current retirees’ pensions — the same intergenerational pay-as-you-go principle used by many public pension systems worldwide.

Is the contribution base adjusted every year?

Yes. Each city reviews and publishes (typically mid-year) the new local average salary, which serves as the reference for updating the minimum and maximum contribution-base caps. Companies must adjust their contributions accordingly — using an outdated base is a common compliance mistake.

What happens if a company declares a lower-than-actual salary base to reduce contributions?

This is an illegal practice with real risk: if detected (through an inspection or a worker’s complaint), the company must retroactively make up the contribution shortfall, plus late fees, and can face additional administrative penalties. It can also expose the company to a worker claim if it affects the calculation of other benefits (severance, injury compensation).

What happens to contributions for an internal migrant worker relocating between provinces?

The system allows, through an inter-regional transfer procedure, moving the individual pension account (and largely the medical contribution history) from one locality to another. This is a real administrative process that must be actively handled — it does not happen automatically just by changing address or job.

Is it common for companies to offer private health insurance on top of mandatory social insurance?

Yes, it is a widespread practice, especially at foreign and multinational companies, precisely because social insurance mainly covers the public-hospital network with partial reimbursement. Supplementary commercial health insurance typically provides access to private clinics or international hospitals and broader coverage, and has become a standard competitive benefit for attracting qualified talent.

Do authorities conduct audits or inspections for social insurance compliance?

Yes, actively. Local social insurance offices and tax authorities (which, following a recent reform, jointly collect contributions in many localities) carry out periodic checks and respond to worker complaints. Cross-checking payroll declared for tax purposes against the contribution base declared for social insurance is a common control point for detecting underreporting.

What happens to social insurance if a worker has two simultaneous jobs?

Medical and pension insurance generally can only be contributed through one primary employer (the one managing the formal labor relationship). Work-injury insurance, by contrast, can and should be contributed independently by each employer for the specific work performed under each relationship, since it covers the risk of each employment relationship separately.

Must the company provide the employee proof of their social insurance contributions?

Yes. The employee has the right to be informed by the company and, upon request, to receive proof of their monthly contributions to each insurance. In addition, most localities offer online platforms where the employee can directly check their own contribution history without depending on the company.

Is the Housing Provident Fund only for buying a home, or does it have other financial uses?

Its main use is buying, building, or making major renovations to a home, and it can also be used to access a lower-interest mortgage through the fund’s own lending system (which typically offers lower rates than a standard commercial mortgage) — a real financial advantage that many foreign companies overlook when planning total compensation for their employees in China.

What is the work-injury determination process (工伤认定), and how long does it take?

It is the formal administrative procedure before the social insurance authority to officially recognize an incident as a work injury or occupational disease — an indispensable prior step to accessing insurance benefits. The employer must file the application within 30 days of the accident (the employee or their family can file within one year if the employer does not), and the authority must generally rule within about 60 days, with possible extension in complex cases.

Can an unfavorable work-injury determination be appealed?

Yes. If the employer or the employee disagrees with the authority’s ruling, they can request an administrative reconsideration or file an administrative lawsuit in court within the applicable legal deadlines — it is not a final, unappealable decision at first instance.

How does medication coverage work under social medical insurance?

Social medical insurance reimburses medications according to a national catalog (plus supplementary provincial lists) sorted into categories — Category “A” drugs are reimbursed in full at the applicable rate, Category “B” drugs require an initial patient co-payment before reimbursement applies, and drugs outside the catalog are generally not covered at all except in limited exceptions. This structure is key to understanding why many foreign employees value supplementary commercial insurance.

Do non-full-time workers have access to medical and pension insurance?

The employer of a non-full-time worker is mainly obligated only for work-injury insurance, not the full set of five insurances. However, the worker themself can voluntarily and individually enroll in and contribute to pension and medical insurance as a “flexible”/self-employed-style participant, under a different rate structure than a full-time employee.

What is urban-rural resident medical insurance, and how does it differ from employee medical insurance?

It is a separate scheme (居民医保), designed for people without formal employment — students, children, elderly people without a work pension, informal workers — funded through a combination of an individual contribution and a government subsidy, with generally lower coverage and contributions than employee medical insurance (职工医保). A formal employee hired by a company must always be under the employee scheme, not this one.

What is the Social Security Card (社保卡), and what is it used for in practice?

It is a physical card (increasingly also digital) issued to each person enrolled in the system, which functions as the credential used to access insured medical services (presented at the hospital or pharmacy at the point of care) and, in many localities, also integrates basic banking functions for receiving benefit payments. It is a practical everyday item, not just an abstract administrative record.

Is there a mandatory contribution related to employing people with disabilities?

Yes. Many localities require companies to employ a minimum proportion of workers with disabilities (often around 1.5% of headcount); if the company falls short of that ratio, it must pay a “disability employment security fund” levy (残疾人就业保障金), calculated based on the shortfall. It is not part of the five insurances, but it is a real HR-related obligation many foreign companies are unaware of.

Can an employer choose to pay the employee cash instead of enrolling them in social insurance?

No, and this has been reinforced in recent years through case law: agreements where the employee “agrees” to receive cash in hand instead of the company making the mandatory contributions are considered void for contravening a mandatory public-policy rule, even if the employee signed in agreement — the employee can later claim the unmade contributions, and that prior agreement is not a valid defense for the employer.

What happens to an employee’s social insurance during unpaid leave?

Generally, during authorized unpaid leave, the obligation to continue social insurance contributions remains in effect (unlike salary, which is suspended) — the company and employee must keep contributing under local rules to avoid a coverage gap, though in practice some localities allow temporary suspension arrangements in specific, well-documented cases.

How does a foreign company verify that a candidate’s declared contribution history is accurate?

Official local platforms and inquiries exist where, with the candidate’s authorization, their social insurance contribution history can be verified — an increasingly common practice in hiring processes to confirm a candidate’s declared work history, since the contribution record is, in practice, a fairly reliable log of a person’s prior formal employment.

What is the relationship between social medical insurance and critical illness insurance

Critical illness insurance is an additional layer of coverage, funded within the social medical insurance system, specifically designed to reduce the financial burden of very high medical expenses that exceed certain ordinary reimbursement caps — it does not require a separate employee contribution and kicks in automatically once expenses cross the locally defined threshold.

Does social medical insurance cover preventive check-ups, or only treatment of existing conditions?

Social medical insurance’s main focus is treating already-diagnosed illnesses and injuries, with limited or no coverage for routine preventive check-ups — this is why many companies, especially foreign ones, offer a company-paid annual health check-up (年度体检) as an additional benefit, separate from the mandatory social insurance system.

What is a special collective contract (专项集体合同), and how does it differ from a general one?

In addition to the general collective contract (covering pay, working hours, rest, etc.), the law allows negotiating special collective contracts dedicated to a specific topic — for example, occupational safety and health, protection of female workers’ rights, or the wage adjustment mechanism — negotiated and approved through the same procedure as the general collective contract but limited to that specific subject.

Does a collective contract take effect immediately upon signing?

Not exactly. Once signed, it must be submitted to the labor administrative authority; if that authority raises no objections within 15 days of receiving the text, the contract automatically takes effect — this is a passive administrative review mechanism, not an active prior approval required before the agreement can be signed.

What happens to the Housing Provident Fund if the employee never buys a home in China?

The accumulated balance is not lost — it remains in the account under their name and can be withdrawn at retirement, or earlier if another recognized ground applies (permanently leaving the country, paying rent, major medical expenses, etc.). It is not a contribution that is “lost” simply for not being used specifically to buy housing.

What is medical insurance “portability” between cities, and what are its real limitations?

Although a mechanism exists to transfer the medical account between localities, real portability of coverage (being able to receive care in any city without extra procedures) remains limited — receiving treatment outside the city of registration often requires prior authorization or results in a lower reimbursement rate than treatment in the home locality.

How does the hukou (household registration) system affect access to social insurance?

Hukou is the domestic residence registration system that historically determined where a person could fully access certain public services (education, some local-resident benefits) — its direct impact on modern labor-related social insurance has been significantly reduced, since the five insurances today are mainly tied to the place of formal employment, not the person’s origin hukou, though certain minor administrative differences between local residents and internal migrants can still exist depending on the locality.

Are employees on probation covered by social insurance from day one?

Yes, without exception. The obligation to register the employee and make social insurance contributions arises from the actual start of the employment relationship, including the probation period — there is no exemption or grace period simply because the employee is still on probation.

What happens to social insurance if the employer changes its legal name or is acquired by another company?

The continuity of the employee’s social insurance contributions must be maintained without interruption when there is a merger, acquisition, or change of legal name — the successor entity inherits the obligation to continue contributions, consistent with the same continuity recognized for the rest of the employment relationship in these cases.

Is there any specific social insurance benefit for employees with disabilities?

Yes — beyond the employment-quota compliance already mentioned, employees with disabilities may access differentiated conditions under certain support programs, in some cases including additional subsidies or reduced employer contribution rates for that specific hire, depending on each province’s labor-inclusion policies.

What is the statutory retirement age in China, and is it changing?

Traditionally the retirement age was 60 for men and 50-55 for women (depending on whether they were blue-collar or white-collar workers) — starting in 2025, a gradual, progressive increase to these ages is being phased in over several years, so the exact age applicable to a given worker depends on their birth year under the transition schedule in effect.

Does work injury insurance cover accidents that occur during the employee’s commute?

Yes, under certain conditions — an accident occurring during a reasonable commute between home and the workplace (or another recognized habitual route) can qualify as a work injury if the employee was not primarily at fault for the incident (for example, in a traffic accident where the other party bore primary or full responsibility).

What pension benefits do dependent family members receive if the employee dies?

The system provides a funeral subsidy and a survivor’s maintenance pension for the deceased worker’s direct dependents (spouse, minor children, or dependent parents, among others meeting the requirements), funded from the pension insurance’s pooled fund, as part of the system’s protection in the event of the contributor’s death.

Do companies in high-risk industries pay a higher work injury insurance rate?

Yes — unlike the other four insurances, where the rate is more uniform, the work injury insurance rate is set according to the risk classification of the company’s industry (construction and mining, for example, with considerably higher rates than an office-based sector), and it can also be adjusted based on the company’s own accident history.

Can an employee choose to retire before or after the statutory retirement age?

Early retirement is very restricted and only recognized in exceptional cases defined by law (certain especially arduous or hazardous jobs, recognized disability); the progressive retirement-age increase reform introduced starting in 2025 also incorporates some limited flexibility for an employee to choose to defer retirement within a capped range, subject to agreement with the employer.

Are there official digital platforms to check and manage social insurance contributions?

Yes — authorities have developed public-service digital platforms and apps (both national and local) that allow employees to check their contribution history and companies to file declarations and make payments, significantly reducing the in-person procedures that were previously the norm for these matters.

What happens if a worker has not completed the minimum 15 years of pension contributions by retirement age?

They can choose to keep contributing voluntarily until reaching the required minimum, or transfer their accumulated individual account to an urban-and-rural resident pension insurance scheme (with different access rules), rather than automatically losing the right to any pension benefit.

Can an employee freely choose between employee medical insurance and resident medical insurance, or does it depend on their employment status?

It is not a free choice — a formally employed worker under a labor contract must be enrolled in employee medical insurance (with contributions from both employer and employee), while urban-and-rural resident medical insurance is designed for those without that type of formal employment relationship, such as independent workers or people without formal employment.

Is there a special work injury insurance mechanism for construction workers hired by project?

Yes — since construction workers typically rotate between different projects and contractors more fluidly than in other sectors, many localities have implemented a work injury insurance mechanism tied to the construction project itself (rather than solely to the individual employer), aiming to ensure continuous coverage despite the high labor mobility characteristic of the sector.

If an employee works remotely for a company registered in a different city than where they reside, in which locality are their social insurance contributions made?

In principle, contributions are made in the locality where the employing entity (or its branch authorized to hire) is registered, not necessarily the city where the remote employee physically resides — this can create a need for portability or transfer procedures if the employee later seeks to access medical services or benefits in their actual city of residence, a point worth planning carefully in cross-city remote work arrangements.

No exactamente.
