Frequently asked questions
What is the minimum wage in Australia in 2026?
From 1 July 2026 the National Minimum Wage is $26.44 per hour, or $1,004.90 per week based on 38 ordinary hours. It is the base rate for adult employees who are not covered by an award or registered agreement. The Fair Work Commission reviews it every year, and most changes begin in the first full pay period on or after 1 July.
Do I pay the National Minimum Wage or the award rate?
For most employees the minimum wage is set by the award that covers their industry or occupation, not by the National Minimum Wage. Employees covered by an award or registered agreement are entitled to at least those rates, including penalty rates and allowances, even where they are higher than the National Minimum Wage. The National Minimum Wage applies only to employees no award or agreement covers. The Fair Work Ombudsman’s Pay and Conditions Tool and downloadable pay guides show the rates that apply.
How much more do casual employees get?
Casual employees who are not covered by an award or agreement get a 25% loading on top of the National Minimum Wage. Employees under an award or agreement get the casual loading or casual rate that instrument sets, so check it. Casuals generally do not get most types of paid leave, notice of termination or redundancy pay, even if they work regularly for a long time.
What are penalty rates and allowances?
Penalty rates are higher pay rates for working at particular times, such as weekends, public holidays, late at night, early in the morning or extra hours. Allowances cover things such as special clothing, dirty work, using your own vehicle or travel for work. The exact amounts depend on the award, agreement or other instrument that applies, and employees must always receive at least what the applicable award provides regardless of the arrangement in place.
Do junior and apprentice rates apply?
Junior pay rates are a percentage of the adult rate for employees under 21 and exist only where the award or enterprise agreement includes them; the percentages usually depend on age. Awards such as Building and Construction, Electrical, Plumbing, Security and Social, Community, Home Care and Disability have no junior rates. Under the Hospitality and Restaurant awards, juniors who sell or serve alcohol must be paid the adult rate. The Fair Work Commission has also announced upcoming changes to junior wages in the Retail, Fast Food and Pharmacy awards. Apprentice and trainee rates are set by awards, or for agreement-free apprentices by the Miscellaneous Award 2020.
When and how must wages be paid?
The award or agreement sets whether pay is weekly, fortnightly or monthly; if it says nothing, employees must be paid at least monthly. Wages must be paid in money — cash, cheque, money order or postal order payable to the employee, or electronic transfer — and not in goods. If wages are paid in cash, both parties should sign a record of the amount.
Must employees be paid for all the time they work?
Yes. Employees need to be paid for all time spent working, which includes time in meetings and time spent on training, including online or at home.
What must a pay slip contain and when is it due?
A pay slip must be given within 1 working day of pay day, even if the employee is on leave, in paper or electronic form. It must include the employer’s and employee’s names, the employer’s ABN where applicable, the pay period, the date of payment, gross and net pay, and any deductions. For hourly-paid employees it must show the ordinary hourly rate, hours worked at that rate and the total amount. It must also list super contributions paid or to be paid and the fund. Providing false or misleading information on a pay slip can attract penalties.
How long must pay records be kept?
Time and wages records must be kept for 7 years. They must be legible, in English, readily accessible to a Fair Work Inspector, and cannot be changed except to correct an error or be false or misleading. Employees can ask to see their records, including after they stop working for the employer. Fair Work Inspectors can issue infringement notices where records are missing or incorrect.
Can an employer deduct money from wages?
Only in limited situations, for example deductions the employee authorises or ones allowed under an award, agreement or employment contract. An employer can also require an employee to spend or repay money only in limited situations, and cashback schemes are against the law. Overpayments have their own rules.
Do visa holders get the same minimum pay?
Yes. Visa workers are entitled to the same minimum pay rates and conditions as any other employee in the same job, and they keep those entitlements even if they have breached a visa condition. It is also illegal to ask for or receive a benefit in exchange for visa sponsorship.

Preguntas frecuentes
